Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and NDoorFun ("NDoorFun," "we," "us," or "our"), governing your access to and use of the NDoorFun website located at ndoorfun.com, the NDoorFun App, and the NDoorPutt hardware device (collectively, the "Services").

By accessing or using our Services, creating an account, or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this requirement.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our website at least 30 days before the changes take effect. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms.

3.1 Account Creation To access the NDoorFun App and its features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@ndoorfun.com if you suspect any unauthorised use of your account.

3.3 One Account Per User Each person may maintain only one active NDoorFun account. We reserve the right to terminate duplicate accounts.

4.1 NDoorPutt Hardware NDoorPutt is a physical putting training device sold separately. Your purchase of NDoorPutt hardware is subject to our separate Purchase Agreement and Warranty Policy available at ndoorfun.com/warranty. Risk of loss and title for hardware items pass to you upon delivery.

4.2 Hardware Warranty NDoorPutt hardware is covered by a 12-month limited warranty from the date of delivery against defects in materials and workmanship under normal use. This warranty does not cover damage resulting from accident, misuse, unauthorised modification, or service performed by anyone other than NDoorFun or an authorised representative.

4.3 Returns & Refunds Pre-order deposits are 100% refundable until your unit ships. Hardware may be returned within 180 days of delivery under our satisfaction guarantee, provided the device has been used for a minimum of 90 days. To initiate a return, contact hello@ndoorfun.com. 5.1 Free Access The NDoorFun App is available in a free version that provides access to a limited selection of green terrain maps and core putting data analysis features. A free account requires registration.

5.2 Paid Subscription A paid subscription unlocks full access to all NDoorFun App features, including AI Coach Mode, Personalised Training, the complete and continuously expanding green library, all Game Modes, Competition Mode, and all future features and content added to the platform.

5.3 Automatic Renewal — IMPORTANT NOTICE TO CALIFORNIA RESIDENTS AND ALL SUBSCRIBERS: Your NDoorFun subscription will automatically renew at the end of each billing period at the then-current subscription rate unless you cancel before the renewal date. By subscribing, you authorise NDoorFun to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings or by contacting hello@ndoorfun.com. Cancellation will take effect at the end of your current billing period. No partial refunds are provided for unused portions of a subscription period.

5.4 Founding Member & Early Bird Access Founding Member customers receive complimentary access to all NDoorFun App features for as long as the product is supported. Early Bird customers receive 12 months of complimentary access. Upon expiration of complimentary access, standard subscription pricing applies unless you choose to cancel.

5.5 Price Changes We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice of any price changes to active subscribers. Your continued use of the subscription after the price change takes effect constitutes your acceptance of the new pricing.

5.6 Feature Updates NDoorFun reserves the right to add, modify, or remove features from the App at any time. We will endeavour to provide reasonable notice of any material changes that remove functionality subscribers currently rely on.

6.1 Our Content All content included in or made available through our Services — including the NDoorFun App, green terrain models, coaching algorithms, training programmes, game modes, text, graphics, logos, and software — is the property of NDoorFun or its content suppliers and is protected by United States and international intellectual property laws.

6.2 Limited License NDoorFun grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use only. This licence does not include any right to resell or make commercial use of the Services or their contents.

6.3 Restrictions You may not copy, modify, distribute, sell, or lease any part of our Services or included software. You may not reverse engineer or attempt to extract the source code of the NDoorFun App or any related software, unless applicable law permits this.

6.4 Your Content You retain ownership of any content you submit through the Services, including training notes or competition results. By submitting content, you grant NDoorFun a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content in connection with providing and improving the Services.

You agree not to use the Services to:

•Violate any applicable law or regulation

•Infringe the intellectual property rights of any third party

•Upload or transmit viruses or any other malicious code

•Attempt to gain unauthorised access to any part of the Services

•Interfere with or disrupt the integrity or performance of the Services

•Harvest or collect information about other users without their consent

•Use the Services for any commercial purpose without our prior written consent

The NDoorFun App may integrate with or contain links to third-party services, including payment processors, analytics providers, and platform services. These third-party services are governed by their own terms of service and privacy policies. NDoorFun is not responsible for the practices of any third-party services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NDoorFun does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. NDoorFun does not warrant that any coaching feedback, training recommendations, or performance analysis provided through the Services will result in improved athletic performance.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NDOORFUN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF NDOORFUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL NDOORFUN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NDOORFUN IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless NDoorFun and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.

NDoorFun reserves the right to suspend or terminate your account and access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 6, 9, 10, 11, and 12 of these Terms shall survive termination.
